Request for Tydings Waiver for Consolidated Administrative Funds of ARP and ESEA Programs

Purpose

The Maryland State Department of Education (MSDE) is requesting a waiver of section 421(b) of the General Education Provisions Act for federal fiscal year (FY) 2022 to extend the period of availability for consolidated administrative funds until March 31, 2026.

As required under ESSA section 8401(b)(3)(A), prior to submitting a waiver request for any program authorized under ESSA, the State must provide the public and local education agencies (LEAs) with notice and a reasonable opportunity to comment and provide input on a proposed waiver request. This communication serves as notice of MSDE’s intent to submit a Tydings waiver request to the U.S. Department of Education (USDE) for FFY 2022 to extend the period of availability of consolidated administrative funds for the following programs:

  • American Rescue Plan Elementary and Secondary Schools Emergency Relief (ARP ESSER)

  • American Rescue Plan Emergency Assistance to Nonpublic Schools (ARP EANS)

  • American Rescue Plan Homeless Children and Youth (ARP HCY)

  • Title I, Part A of the ESEA, Improving Basic Programs Operated by the LEAs

  • Title IV, Part A of the ESEA, Student Support and Academic Enrichment Grants

This is an invitation for the public to provide feedback on the proposed waiver request. Please submit your comments by January 24, 2025. via email to localessaconsolidated.msde@maryland.gov. Copies of all public comments received will be included as part of the waiver request submission.
