Decision Summary: The ALJ concluded that the student was not denied FAPE when the LEA provided comparable services from the prior in-state IEP for the 2022 - 2023 SY while developing a new IEP. The ALJ further concluded that the LEA had no legal obligation to provide comparable services from the prior in-state IEP for 2023 - 2024 and 2024- 2024 SY, once it developed its own IEP. The ALJ also concluded that the LEA developed a reasonably calculated IEP with appropriate accommodations and after consideration from private reports provided by the parents for the 2022-2023, 2023-2024 and 2024-2025 SY. The ALJ dismissed the case and denied the parents’ request for reimbursement and placement at a nonpublic school.
