24-H-AARU-14239 | 10/31/2024 | Parent/Guardian | Placement/LRE/complainant requesting less restrictive, Nonpublic Placement/Tuition Reimbursement |
Decision Summary: The ALJ concluded that the IEP and placement by the LEA for the 2024- 2025 SY was appropriate and provided the student with FAPE. 24-H-CITY-16656 | 11/26/2024 | Parent/Guardian | IEP Development/Review/Revision; IEP Implementation-accommodations, aids & services, modifications; Independent Educational Evaluation Procedures |
Decision Summary: The ALJ concluded that the student was not denied FAPE when the LEA provided comparable services from the prior in-state IEP for the 2022 - 2023 SY while developing a new IEP. The ALJ further concluded that the LEA had no legal obligation to provide comparable services from the prior in-state IEP for 2023 - 2024 and 2024- 2024 SY, once it developed its own IEP. The ALJ also concluded that the LEA developed a reasonably calculated IEP with appropriate accommodations and after consideration from private reports provided by the parents for the 2022-2023, 2023-2024 and 2024-2025 SY. The ALJ dismissed the case and denied the parents’ request for reimbursement and placement at a nonpublic school. |
24-H-MONT-20142 | 11/8/2024 | Parent/Guardian | Placement/LRE/complainant requesting more restrictive; IEP Implementation-Placement |
Decision Summary: The ALJ determined that the program proposed by the LEA in a regional program was the LRE and provided FAPE for the student. The parent proposed placement at a less restrictive comprehensive school was denied. |
24-H-MONT-21942 | 10/21/2024 | Parent/Guardian | Placement Determination; Placement/LRE/complainant requesting less restrictive; Nonpublic Placement/Tuition Reimbursement |
Decision Summary: The ALJ concluded the LEA provided the student with FAPE. Therefore, the student was not entitled to compensatory services in the form of nonpublic placement funded by the LEA for the 2024-2025 SY.
