Decision Summary: The ALJ concluded that the LEA failed to provide an elementary school aged student with autism and unregulated behavior with FAPE in the LRE for the 2023-2024 school year. The ALJ found that there was agreement on the goals, supplementary aids and services, and accommodations. There were components missing from the FBA, which impacted the sufficiency of the BIP. The ALJ ordered that the school system reimburse the parents for the cost of tuition for the 2023-2024 SY. The ALJ further concluded that the LEA did provide the student FAPE in the area of speech and language and there was no need for OT goals. |

The ALJ concluded that it was difficult to determine the degree of the student’s progress given the impact of her absences. |
